1. Acceptance of Terms
By accessing createepichome.com, submitting any form, or engaging Create Epic Home LLC ("Company," "we," "us") for services, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Site or our services.
2. About Our Services
Create Epic Home provides home renovation and remodeling services including, but not limited to: interior decorating, exterior and garden renovation, roofing, solar installation, window and floor installation, bathroom remodeling, and home and fire security installation and maintenance. All physical work is performed under a separate written contract executed between you and the Company, which prevails over these Terms in the event of any conflict.
3. Website Use & Eligibility
- You must be at least 18 years old and the property owner or an authorized representative to request estimates or book services.
- You agree to provide accurate, current, and complete information in all forms and communications.
- You may not use the Site for any unlawful purpose, to submit fraudulent enquiries, or to interfere with its operation.
4. Estimates, Quotes & Pricing
- All estimates and consultations advertised on the Site are free and carry no obligation.
- Written quotes are valid for 30 days from the date of issue unless stated otherwise.
- Quoted prices are fixed for the defined scope of work. Changes to scope requested by you, or unforeseen concealed conditions (e.g., hidden water damage, structural defects, code-required upgrades), will be documented via a written change order and priced before additional work proceeds.
- Prices displayed on the Site are starting points for typical projects and do not constitute an offer or binding quote.
5. Scheduling, Access & On-Time Commitment
- Start and completion dates are set in your written contract. Weather, permit delays, supply-chain disruptions, or change orders may adjust timelines with written notice.
- Our "$100/day on-time credit" applies only when a contractually guaranteed completion date is missed without qualifying cause, and is credited against your final invoice.
- You agree to provide safe, reasonable access to the work area during agreed working hours (Monday–Saturday, 8 AM – 6 PM CT, unless otherwise agreed).
6. Payments & Financing
- Payment schedules (deposit, milestones, final payment) are defined in your written contract. We never request full payment upfront.
- Financing, including 0% APR promotional plans, is provided by independent third-party lenders and is subject to credit approval ("OAC"). The Company is not the lender and makes no credit decisions.
- Late payments may incur interest at the lesser of 1.5% per month or the maximum permitted by North Dakota law.
7. Warranties
- Workmanship Warranty: a 5-year limited warranty on labor and installation, transferable once to a new homeowner, as detailed in your completion certificate.
- Manufacturer Warranties: materials carry their own manufacturer warranties, which we register and assign to you where possible.
- The workmanship warranty excludes ordinary wear and tear, misuse, unauthorized alterations, acts of nature, and work performed by others.
8. Permits, Codes & Insurance
Unless your contract states otherwise, the Company obtains required building permits and schedules inspections. All work complies with applicable building codes. The Company maintains general liability and workers' compensation insurance; certificates are available upon request.
9. Intellectual Property
All Site content — text, design, graphics, logos, and imagery — is the property of Create Epic Home LLC or its licensors and is protected by U.S. copyright law. You may not reproduce, distribute, or create derivative works without our prior written consent. Design concepts and 3D renderings prepared for your project remain our property until final payment, after which a license to use them for your personal, non-commercial purposes is granted.
10. Limitation of Liability
To the maximum extent permitted by law: (a) the Site is provided "as is" without warranties of any kind; (b) the Company's total liability arising from Site use is limited to $100; (c) liability arising from contracted work is limited to the amounts paid by you for that project, except where a larger amount is required by the written contract, applicable warranty, or law. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Indemnification
You agree to indemnify and hold harmless the Company from claims arising from information you provide that is inaccurate, your breach of these Terms, or your misuse of the Site.
12. Communications & Marketing
By submitting a form, you consent to be contacted by phone, email, or text regarding your enquiry. Marketing emails always include an unsubscribe link, or you may unsubscribe here at any time. Transactional and warranty communications may still be sent as needed to serve you.
13. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of North Dakota, USA, without regard to conflict-of-law principles. The parties agree to attempt good-faith resolution of any dispute for 30 days before pursuing formal action. Any unresolved dispute shall be brought exclusively in the state or federal courts located in Cass County, North Dakota.
14. Third-Party Links & Services
The Site may reference third-party services (lenders, maps, social platforms). We do not control and are not responsible for third-party content, terms, or practices.
15. Changes to These Terms
We may update these Terms periodically. The "Effective Date" above will change with material updates. Your continued use of the Site constitutes acceptance. Contracts already signed remain governed by the terms in effect when signed.
